Having heard learned counsel for the petitioner and without commenting anything as regards merits of the case or as regards veracity of averments made in the petition, the instant petition is disposed off with a direction to respondent No.2 – Senior Superintendent of Police, District Patiala, Punjab to look into the matter and to get the representation dated 20.1.2024 (Annexure P-12) examined in accordance with law qua the alleged threat perception of the petitioner. In case, it is found that there is any gunine threat to the life and liberty of the petitioner, then necessary steps as may be warranted under law be taken thereupon at the earliest so as to ensure that no harm is caused to the petitioner in any manner.

As far as lodging of the FIR against the private respondents is concerned, it shall be open to the petitioner to have recourse to other alternate efficacious remedies as may be available to him including filing of an application under Section 156(3) Cr.P.C. before the Area Magistrate concerned.

In case, any such application is filed, the Area Magistrate concerned shall consider the same in accordance with law and dispose of such application expeditiously.

A copy of this order alongwith copy of representation dated 20.1.2024 (Annexure P-12) be sent to respondent No.2 – Senior Superintendent of Police, District Patiala, Punjab for necessary compliance.
