The petitioner is praying for grant of bail as he is in custody for allegedly committing offence punishable under Section 11 of Prevention of Cruelty to Animals Act and Section- 12(1) of Jharkhand Bovine Animal Prohibition of Slaughter Act, in connection with S.T. No.1 of 2024, arising out of Chowka Police Station Case No.46 of 2023, corresponding to G.R. Case No.398 of 2023, pending in the Court of learned Additional Sessions Judge, Chandil.
Heard, learned counsel for the petitioner and learned counsel for the State and have also gone through the impugned order.
It is alleged that the petitioner was returning after purchasing bovine animals carrying in two vehicles. The prayer for bail of the petitioner was earlier rejected with a liberty to renew his prayer after framing of charge. The charge has already been framed.
Learned counsel for the State has opposed the prayer for bail. Considering the aforesaid facts and the fact that the charge has been framed and petitioner is in custody since 04.08.2023, I am inclined to grant bail to the petitioner. Accordingly, the petitioner, named above, is directed to be released on bail on furnishing bail bond of Rs.10,000/-(Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Additional Sessions Judge, Chandil in connection with S.T. No.1 of 2024, arising out of Chowka Police Station Case No.46 of 2023, corresponding to G.R. Case No.398 of 2023.
