Umesh Chandra Dhyani, J.—Applicant Manoj Kumar, who is in jail in connection with Case Crime No. 322 of 2007, relating to offences punishable under Sections 420, 467, 468, 471, 380, 201 and 120B of IPC, Police Station-Gang Nahar, District Haridwar, has sought his release on bail.

Heard learned counsel for the parties, perused the materials on record and gone through the grounds taken up in the bail application.

First bail application of the accused-applicant was dismissed on merits by this Court on 01.12.2012. Second bail application was also dismissed by this Court on merits vide order dated 19.06.2013.

This Court need not repeat the facts and circumstances leading to the rejection of first and second bail applications of the applicant. Orders passed earlier in this respect are adopted and made part of this Order.

The applicant is not only the guarantor but is also the Director of the bank in whose name the loan worth more than Rs. 5 crore is said to have been taken fraudulently and by forged papers. Also, the applicant is not entitled to the benefit of Section 436A of the Cr.P.C., in as much as, he has not completed half of the period of sentence provided for the offence. No new ground is available to the applicant.

Third bail application of the applicant is, therefore, dismissed.
