Judgment
Plaintiff in O.S.No.497/2019 on the file of Munsiff Court, Thiruvalla, has sought for issue of direction to the court below for speedy disposal of the suit within a time frame to be fixed by this Court.
A report was called for in this respect from the court below. In the report dated 11.01.2021, the court below has stated that defendant is yet to file written statement. It is further stated that this is a case where survey commission will have to be taken out which is a time consuming process.
Considering the report submitted by the court below, I am of the opinion that sufficient time shall be given to the court below for disposal of the suit.
In the result, original petition is disposed of calling upon the court below to dispose of the suit within a period of three months from the date of completion of pre trial steps as suggested by the court. This order shall take effect from the date of production of certified copy of this judgment.
All pending interlocutory applications will stand closed.
