The original petition is filed to direct the Court of Munsiff, Thiruvananthapuram to consider and dispose of O.S. No.536/2009 within a time frame.
Pursuant to the order dated 08.12.2021 passed by this Court, the learned Additional Munsiff (RCC), Thiruvananthapuram, by communication dated 14.12.2021, has informed this Court that the suit stands posted for commissioner’s report on 06.11.2022. The court below has not mentioned anything about the reasonable time period required to dispose of the suit.
Heard; Sri.Vishuprasad Nair, the learned counsel appearing for the petitioner. Even though service of notice is complete on the respondents 1 to 3 and 5, there is no appearance for them.
In the light of the pleadings and materials on record and after perusing the communication of the learned Munsiff, in exercise of the supervisory powers of this Court under Article 227 of the Constitution of India, I direct the Court of the Additional Munsiff (RCC), Thiruvananthapuram to consider and dispose of O.S. No.536/2009, in accordance with law, as expeditiously as possible, at any rate, within a period of six months from the date of completion of pre-trial steps.
The original petition is ordered accordingly.
