Applicant-Manoj Kapri, who is in jail in connection with Case Crime No. 10 of 2011, relating to offences punishable u/s 306 and 506 I.P.C., police station Kotwali Champawat, District Champawat, has sought his release on bail.

Learned Counsel for the Applicant submitted that admittedly, the girl committed suicide. It is also not disputed that the deceased and the accused (Applicant) were class fellow and they were students of class XII. It is also evident from the First Information Report that the Applicant had friendship with the girl and he wanted to marry her. But parents of the girl did not agree for marriage as the girl and the boy were related to each other (distant maternal uncle and niece).

In the above circumstances, having considered submissions of learned Counsel for the parties, this Court is of the view that it is a fit case for bail. Bail Application is allowed.

Let the Applicant- Manoj Kapri be released on bail on executing personal bond and furnishing two sureties, each of the like amount, to the satisfaction of the Chief Judicial Magistrate, Champawat.
