Judgment
Ravindra Maithani, J
Applicant is in judicial custody in Case Crime No.158 of 2024 (FIR No.158 of 2024), under Section 306 IPC, Police Station Rudrapur, District Udham Singh Nagar. He has sought his release on bail.
Heard learned counsel for the parties and perused the record.
The deceased was a young girl of 15 years. On 21.03.2024, she was alone in her house. When the applicant started molesting her, the deceased telephoned the informant, the father of the deceased. In the evening, it was revealed that the applicant molested the deceased and he had done so on the earlier occasions also. Next morning, the deceased was found dead; she committed suicide.
Learned counsel for the applicant would submit that it is not a case of abetment to suicide. It is not a case that the victim has no other option, but to commit suicide.
Learned State Counsel would submit that the applicant continuously harassed the victim, due to which, she committed suicide.
Having considered the entirety of facts, this Court is of the view that the applicant deserves to be enlarged on bail.
The bail application is allowed.
Let the applicant be released on bail, on his executing a personal bond and furnishing two reliable sureties, each of the like amount, to the satisfaction of the court concerned.
