Judgment
Prayer in the present writ petition is for issuance of an appropriate writ, order or direction, particularly a writ in the nature of Mandamus, directing respondent No.4 to issue an appointment letter in favour of the petitioner and permit him to join his duties against the post of Group-D under the ESP Category, pursuant to his selection by respondent No.5 under the Common Cadre of the Human Resources Department (Common Cadre Group-D), Haryana, as the petitioner has not been issued an appointment letter solely on account of non-verification of his Sports Gradation Certificate (Annexure P-4), despite his having been duly selected, whereas a similarly situated candidate, namely Jagmohan Singh, who had played the same game under the same Sports Federation, has already been issued an appointment letter and permitted to join pursuant thereto vide appointment letter dated 23.12.2025 (Annexure P-24); and for issuance of an appropriate writ, order or direction directing the respondents to treat and accept the Sports Gradation Certificate (Annexure P-4) issued in favour of the petitioner as valid and duly operative for all intents and purposes and to complete the verification thereof expeditiously, in view of the appointment already granted to the similarly situated candidate; and further for issuance of a writ in the nature of Mandamus directing the respondents to allot a permanent department to the petitioner upon his appointment and joining; and for issuance of an appropriate writ, order or direction directing respondent Nos.1 to 4 to grant the petitioner seniority and all other consequential service benefits from the date on which the similarly situated candidate was appointed.
It is, inter alia, submitted by learned counsel for the petitioner that pursuant to Advertisement No.1/2023 dated 30.05.2023 (Annexure P-1), the petitioner applied for appointment to a Group-D post under the ESP-BC(B) Category. It is submitted that the selection to the advertised posts was to be made on the basis of the Common Entrance Test (CET). The petitioner was eligible to participate in the selection process, having qualified the Common Entrance Test (CET). The petitioner thereafter participated in the written examination and, as per the result dated 12.01.2024 (Annexure P-5), secured 39.56 marks. As per the final result dated 10.08.2024 (Annexure P-7), the cut-off marks for the petitioner's category were 39.35. Accordingly, the petitioner claims to have been selected for appointment.
Learned counsel for the petitioner submits that, despite the aforesaid selection, after two years, no appointment letter has been issued to the petitioner and no department has been allotted to him. It is further pointed out that a similarly situated candidate, namely Jagmohan Singh, has already been appointed and issued an appointment letter dated 23.12.2025 (Annexure P-24).
It is submitted that, in this regard, the petitioner submitted a Legal Notice dated 22.07.2026 (Annexure P-10) to the respondent-Department, which is pending consideration. Learned counsel for the petitioner submits that the petitioner would be satisfied, at this stage, if a direction is issued to respondents to consider and decide the aforesaid Legal Notice dated 22.7.2026 (Annexure P-10).

Mr. Harish Kumar Nain, DAG, Haryana accepts notice on behalf of respondent-State and submits that he has no objection in case the aforesaid limited prayer of learned counsel for the petitioner is accepted.
Heard.
Without expressing any opinion on the merits of the claim raised by the petitioner, and in view of the limited relief sought, the present writ petition is disposed of with a direction to the respondents to consider and decide the Legal Notice dated 22.7.2026 (Annexure P-10) by passing a speaking and reasoned order, in accordance with law, within a period of eight weeks from the date of receipt of a certified copy of this order.
It is made clear that this Court has not expressed any opinion on the entitlement of the petitioner to the claimed benefit, and the competent authority shall take an independent decision in accordance with the applicable rules and regulations.
