Petitioner has filed the petition under Article 226 of the Constitution of India, seeking following reliefs:-

i) That the writ in the nature of certiorari may kindly be issued to quash and set aside the rejection of the petitioner candidature for Post Code-776 as per annexure P-13.

ii) That the writ in the nature of mandamus may kindly be issued to the respondent Commission to treat the registration certificate dated 15.02.21 of petitioner i.e. annexure P-6 which petitioner has produced at the time of evaluation process as satisfying the registration condition of Post Code-776.

iii) That the respondent no.-3 shall be directed by issuing writ in the nature of mandamus to the respondent no.-3 that by treating petition eligible for post code 776 and the candidatures of the petitioner shall be recommended in his respective category against the posts which remains vacant as per result notification dated 18.06.2021 i.e. annexure P- 12.The respondent department shall thereafter be directed to offer appointment to the petitioner as Medical Laboratory Technician Grade-II with immediate effect.”

Mr. Yogesh Kumar Chandel, learned counsel for the petitioner, submits the the case of the petitioner is covered by a judgment dated 15th September, 2021, passed by this Court in CWP No. 3624 of 2021, titled Raveesh Ninta and another versus State of H.P. & Others and connected CWP No.3788 of 2021, titled Green Lata versus State of H.P. and others. He prays that the case of the petitioner may also be directed to be considered by the respondents in terms of the aforesaid judgment dated 15.09.2021. The same are not disputed by learned counsels for the respondents.

In view of the submissions made, the writ petition is disposed of, with a direction to respondent No.3-Himachal Pradesh Staff Selection Commission, Hamirpur, to consider the case of the petitioner in terms of the judgment dated 15.09.2021, passed by this Court in CWP No.3624 of 2021, titled Raveesh Ninta and another versus state of H.P. & Others and connected CWP No. 3788 of 2021, titled Green Lata versus state of H.P. and others, within a period of three weeks from today.

All pending applications, if any, shall also stand disposed of.
