Petitioner has filed the petition under Article 226 of the Constitution of India, seeking following reliefs:-

“(i) That respondent may kindly be directed to considered the certificate of the petition appended as Annexure P-1 valid for Government job and further direct the respondent 4,5, and 6 to consider the said certificate for the post of Multi Task Worker at GPS Movi Seri Under Education block Chachyot-1, District Mandi.

(ii) That the respondents may very kindly be directed to implement the order passed in CWP No.4189/2022 (Annexure P-2) qua the petitioner also.”

On 20.12.2018, the petitioner passed the Matriculation examination and was issued mark sheet and Matriculation certificate by respondent No.3-Grameen Mukt Vidhyalayi Shiksha Sanstahan.

It appears that on 11.02.2019, respondent No.2-Himachal Pradesh Board of School Education Gyana Lok Parisar, Dharamsala, cancelled the recognition/affiliation of respondent No.3.

Applications for the post of part time Multitask Worker were invited by the respondent-State and the petitioner had appeared before the Selection Committee for verification of the certificates/documents required for the said post. Upon verification of the 10th Class certificate of the petitioner, respondent No.2 declared the same as not valid.

Learned counsel for the petitioner has tendered a copy of communication dated 23.06.2022 received from Additional Director Higher Education (Administration), whereby it was decided by the State Level Equivalence Board Committee that certificates of10th and 12th issued by respondent No.3 during the period 01.12.2017 to 05.02.2019, would be valid for the purpose of employment in the State of Himachal Pradesh.

In view of the above, we dispose of the writ petition by directing the respondent-State to consider the certificate of the petitioner as valid certificate and also to consider her case for the post of part time Multitask worker, in accordance with law.

Pending miscellaneous application(s), if any, also stand disposed of.
