Manjit Singh vs State of Punjab and Others

Ajai Lamba, J.—This petition has been filed under Article 226/227 of the Constitution of India, praying for issuance of a writ in the nature of certiorari, quashing joint seniority list of Head Constables circulatedin District Kapurthala, vide document, Annexure P-2.

Notice of motion.

On the asking of the Court, Mr. B.S. Chahal, Deputy Advocate General, Punjab, accepts notice on behalf of Respondents. Requisite number of copies of the petition have been given to learned counsel for the Respondents.

On request of learned Counsel for the parties and in view of peculiar facts and circumstances of the case, the matter is taken up for final adjudication today itself.

It has been contended that seniority of Head Constables is to be maintained within the district. The seniority of the Petitioner has been adversely effected by virtue of the action of the Respondents who have allowed the Head Constables from Punjab Armed Police to be inducted in District Kapurthala.

Learned Counsel for the parties are adidem that the matter can be referred to the Committee constituted under Order dated 13.10.2010 passed in Civil Miscellaneous No. 14155 of 2010 in titled ''Sub Inspector Gurbinder Singh and Ors. v. State of Punjab and Ors. Civil Writ Petition No. 11993 of 2010.

In view of the fact that Committee constituted in deference to orders of this Court is already looking into the inter-se seniority of persons, this petition is disposed of with liberty to the Petitionerto approach the Committee constituted under Order dated 13.10.2010 passed in Civil Writ Petition No. 11993 of 2010 titled ''Sub Inspector Gurbinder Singh and Ors. v. State of Punjab and Ors. Civil Miscellaneous No. 14155 of 2010.
