Hon’ble Pankaj Purohit, J. (Oral)

By means of present writ petition, petitioner has challenged the result dated 27.05.2026 insofar as it excludes the petitioner from the final recommendation list for the post of Instructor (Employability Skills) under the scheduled caste category.

2.

Facts, in a nutshell, are that pursuant to advertisement dated 15.02.2024, applications were invited for the post of Instructor (Employability Skills) in Government Industrial Training Institutes. Petitioner offered his candidature for the said post. He participated in the selection process; he was declared qualified in the written examination, and he was also called for the purpose of document verification; but thereafter, name of petitioner was not included in the provisional select list.

3.

It is contended by learned Counsel for petitioner that names of four candidates were recommended to the government for appointment by the respondent-selecting body, but the case of petitioner is still lying undecided, since his name did not find place in the provisional select list.

4.

This Court, vide previous order dated 08.09.2026, had directed the learned Counsel appearing for respondent –Selecting Body to get clear instructions as to whether the candidature of petitioner has been rejected by the selecting body or not.

5.

Today, learned Counsel appearing for respondent-selecting body, on the basis of instructions imparted to him, made a submission that the candidature of petitioner has not been rejected, however, his name was not included in the provisional select list. Those instructions are taken on record.

6.

Since the candidature of petitioner has not been cancelled, it is not discernible as to why his name did not find place in the provisional select list.

7.

In such view of the matter, present writ petition is disposed of finally by permitting the petitioner to make a fresh representation to the respondent-selecting body, ventilating his grievances in detail, within 10 days from today; if any such a representation is filed by petitioner within the time, so stipulated by this Court, the Secretary of the respondent-Selecting Body shall take decision thereupon, within a period of two weeks from the date of receipt of representation, strictly in accordance with law.

8.

Pending application, if any, stands disposed of.
