The instant petition has been filed for the grant of following directions:

(i) That the selection of the respondents No.4 to 6 for the post of Trainer Information and Communication Technology System Maintenance under the Post Code 128 may kindly be quashed and set­aside.

(ii) That the respondents may kindly be directed to award the marks under the Head of six months training and experience as per the scheme and thereafter the respondents may kindly be directed to select and appoint the petitioner for the post of Trainer Information and Communication Technology System Maintenance under the post Code 128".

On 29.09.2020 and thereafter on 13.10.2020 we directed the learned Advocate General to obtain instructions.

Today, the instructions dated 15.10.2020 have been placed on record, the relevant portion whereof reads as under:

"1. That the appointment in question are related to the Institutional Management Committees of the different Industrial Training Institutes running under the Respondent Department. The matter related to leaving the job by respondents No.5 and 6 after submitting their joining, has been clarified from the respective institutes and it has been confirmed by the respective institutes that Respondents No.5 and 6 have left the job after joining.

That as per the merit list in the concerned discipline, Petitioner stood at 5th position i.e. second position in the waiting list in the merit list against the 3 posts advertised. Therefore, consequent upon resignations of respondents No.5 and 6 i.e. Sh. Himanshu Sharma and Ms. Richa Guleria from the post of Trainer ICTSM from Govt. ITI Bangana and Govt. ITI, Chirgaon respectively there are now two vacant posts. The candidature of the petitioner can be considered for the appointment as Trainer ICTSM in order of merit.

Now, that the respondents are ready to consider the case of the petitioner. Accordingly, the instant petition is disposed of with a direction to the respondents to complete the process as initiated by them, as expeditiously as possible and preferably within six months. Pending application(s), if any, also stands disposed of.
