Judgment
Heard Shri M. Devananda, learned Advocate appearing for the petitioner; Shri Ruchir Mishra, learned Advocate along with Shri Sharan Dhulia,
learned Advocate appearing for the Fencing Federation of India and Shri Lenin Hijam, learned Addl. AG appearing for the State Government.
On 3-3-2021, when the application being MC(WP(C)) No. 53 of 2021 was taken up for consideration by this Court, Shri Ruchir Mishra, learned
counsel was given time to seek instruction as to whether the sport players who have been selected by the Manipur Fencing Association, could be
permitted to participate in the tournament commencing from 15th to 17th March, 2021. Today, when the matters are taken up again for consideration,
it has been submitted by him that the Fencing Association of India has given him the instruction in the form of a letter which is shown in the computer.
On perusal of the said letter, it is seen that the Fencing Federation of India has permitted the players to participate in the said tournament provided
they are accompanied by two coaches under the banner of the State Government. So far as the Managers accompanying the players are concerned, it
has been submitted by him that they could be accompanied by the officers nominated by the State Government or if this Court permits the Fencing
Federation of India, they could take care of the players after they have reached the place of tournament.
Keeping in mind the peculiar facts and circumstances and in the interest of sport persons in the State, this Court is of the view that instead of troubling
the Fencing Association of India to take care of them, the State Government may depute two officials as the Managers to accompany the players and
accordingly, the Commissioner (YAS), Government of Manipur and the Director (YAS), Government of Manipur are directed to nominate two
officials from the Directorate of Youth Affairs and Sports to accompany the players who have already been selected by the Manipur Fencing
Association. The Manipur Fencing Association, the petitioner herein is directed to get in touch with the Director (YAS) so as to ensure that the
players leave Imphal and reach the place of tournament in time and the details thereof shall be shared by it with the nominated officials.
List these matters on 15-4-2021 for disposal in the category of admission.
It is made clear that this arrangement is being made by this Court as a one time measure in the interest of the sport persons.
