Judgment
Heard the learned counsels appearing for the parties and perused the documents on record.
Petitioner has been made an accused in connection with Vigilance Case No. 07 of 2017 arising out of Dumka (A.C.B.) P.S. Case No. 04 of 2017 registered for offences under Sections 7/13(2) of Prevention of Corruption Act, 1988.
Petitioner is in judicial custody since 07.06.2017. Opposing the prayer for grant of bail, Mr. T. N. Verma, the learned Special A.P.P. submits that the petitioner was caught red-handed while accepting illegal gratification of Rs. 12,000/-.
One thing which strikes the mind of the Court is, that the informant is said to be own brother of the Vice-chairman of Mihijam Municipal Corporation, Jamtara. The petitioner is working as Clerk in the said Municipal Corporation. It is stated that payment of Rs. 8, 85, 790/- was already made to the informant, however, for issuing payment certificate, the petitioner demanded Rs. 30,000/- which allegedly on negotiation was reduced to Rs. 24,000/-. A charge-sheet has already been submitted in this case.
Having regard to the facts and circumstances of the case, the petitioner-above named, namely, Bijoy Kumar Singh is directed to be released on bail on furnishing bail bond of Rs. 10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Special Judge (A.C.B.), Dumka in connection with Vigilance Case No. 07 of 2017 arising out of Dumka (A.C.B.) P.S. Case No. 04 of 2017, on the condition that he shall co-operate during the trial.
The instant application is allowed. Let a copy of this order be transmitted to the trial Court through FAX.
