It appears that twice the respondent State was allowed time to file counter affidavit, however, till date the counter affidavit has not been filed.
I.A. No.6480 of 2024 has been filed by the respondent State seeking extension of time by way of four weeks for filing the counter affidavit.
Mr. Saurabh Shekhar, the learned counsel for the petitioner submits that counselling for NEET-UG, 2023 Examination is already going on and the schedule is already brought on record by way of filing reply to the said I.A at Annexure R/2 and 14.09.2024 is the last date of joining in the allotted colleges and the course will commence on 01.08.2024. He submits that although the petitioner-college is having 100 seats and out of which only two seats have been filled up in the year 2023 and 98 seats were vacant. He further submits that Government of Jharkhand has already decided to fill up the seats of Laxmi Chandravanshi Medical College and Hospital, Bishrampur, Palamau by way of admitting the students from all the regions of Indian Republic including local residents of Jharkhand State and rest 15 seats will be under NRI quota by way of Annexure-2 to the writ petition.
In view of above, it transpires that if the Government of Jharkhand will take a decision in the light of Annexure-2, which is the decision of the Government of Jharkhand for entering the students in Laxmi Chandravanshi Medical College and Hospital from all over the India and such decision is taken in favour of other institutions in the private colleges, more students will be benefitted.
In view of above and considering the urgency in the matter, the respondent State is directed to file counter affidavit within two weeks.
The prayer made in I.A. No.6480 of 2024 is allowed in the above terms and the said I.A stands disposed of.
Let this matter appear on 01.08.2024.
Let a copy of this order be communicated to the respondent no.2-Secretary, Health, Medical Education and Family Welfare, Government of Jharkhand.
