It is the contention of learned counsel for the applicant that the applicant has superannuated on 31.12.2016 but pension of the applicant has not been fixed in a proper way. In this regard, he contends that the pension of the applicant should have been fixed as per 7th CPC but the same has not been done yet. Learned counsel for the applicant, in this regard, drew our attention to page 9 to 11 of the paperbook which is a representation given by the applicant to the respondents for proper fixation of his pension.

After going through the paperbook, we find that certain documents have been mentioned in the aforesaid representation dated 26.09.2021, which said to have been attached therewith. However, representation is dated 26.09.2019, therefore, we direct the applicant to prefer a fresh representation attaching all required documents with the same.

Accordingly, the applicant is directed to file a fresh representation to the respondents on his grievance, within one weeks from today alongwith all relevant documents and thereafter, the respondents, after receiving it alongwith attached necessary documents, are directed to take a decision on the representation of the applicant by passing a detailed reasoned speaking order within six weeks from the date of receipt of the same. If the facts mentioned in the representation of the applicant are otherwise found to be in order and within relevant rules, the pension of the applicant must be fixed in a proper way.

With the above directions, OA is disposed off at the admission stage itself. It is made clear that nothing has been commented on merits of the case while disposing off the present case.
