This application under Section 528 of BNSS, 2023 has been filed by the applicant/petitioner for preponing the date of hearing in the main petition, which is already fixed for 11.01.2027.
Notice in the application.
On advance notice, learned State counsel puts in appearance on behalf of the respondent-State.
On oral request of both the counsel, the main case i.e. CRM-M-49198-2025 is preponed from 11.01.2027 to 31.08.2026 i.e. today itself.
Application stands disposed of.
Main Case
Present petition under Section 528 of BNSS, 2023 has been filed, directing respondent No.2 to take strict legal action on the representation dated 04.08.2025 (Annexure P-6) submitted by the petitioner against private respondent No.4/Sarpanch of Village Baloli, Tehsil Chhachhrauli, District Yamuna Nagar.
On hearing the petitioner’s counsel, following was recorded on 04.09.2025:-

2.Counsel for the petitioner contends that in fact on the representation dated 04.08.2205 (Annexure P-6) submitted by petitioner against respondent No.4, wherein it is specifically pointed out that respondent No.4 was ineligible to contest the elections because of possessing a fake matriculation certificate, no legal action is being taken.
3.It is also argued that earlier also on 20.04.2023, respondent No.4 was removed by Deputy Commissioner from the post of Sarpanch and the appeal filed by him was also dismissed by the Commissioner Ambala, Division Ambala on 14.01.2025 and he was directed to hand over the record of the office.
4.Notice of motion.
5.Mr. Amish Sharma, AAG, Haryana, accepts notice on behalf of the respondents-State of Punjab. He prays for some time to file status report in the matter.
6.List on 15.10.2025."
The Court is informed that after filing of the present petition, FIR already stands registered against the private respondents i.e. FIR No.225 dated 01.10.2025 under Sections 420, 467, 468, 471 IPC, Police Station Chhachhrauli, District Yamuna Nagar.
Status report has already been filed by the respondent-State. In the status report, it has been specifically mentioned that FIR No.225 dated 01.10.2025 under Sections 420, 467, 468, 471 IPC, already stands registered at Police Station Chhachhrauli, District Yamuna Nagar, against respondent No.4-Shyam Singh.
Investigation in the said FIR is still going on and after completion of investigation required action would also follow.
The petition is disposed of with the observation that as already 10 months have passed, the investigation be completed expeditiously.
