Man Dass vs State of H.P.

Justice Kurian Joseph, C.J.—The writ petition is filed with the following prayers: (A) That a writ of certiorari may kindly be issued and impugned notification Annexure P-2 may kindly be ordered to be quashed or in the alternative respondents may be ordered to grant the relief of regularization and monitory benefits with retrospective effect to the petitioner.

(B) That a writ of mandamus directing the respondents to regularize the services of the petitioner after completion of 8 years of daily waged service as per decision of the respondents themselves and to absorb or deploy/depute the petitioner to any other department but as Class-III employees being one rank higher from the post subject to fulfilling the eligibility criteria.

In view of the judgment of this Court in CWP No. 5907 of 2010 titled as Sukh Chain versus State of H.P. and others and other connected matters decided on 4.5.2011, it will be open to the petitioner to make appropriate representation before the second respondent, in which case the matter will be duly examined by the second respondent in the light of the judgment, referred to above. The appropriate action shall be taken within a period of four months from the date of production of a copy of this judgment along with a copy of the writ petition by the petitioner before the second respondent. The writ petition is disposed of, so also the pending applications, if any.
