Birkha Bhadur vs State of H.P.and Others

Kurian Joseph, C.J.—The writ petitions are filed with the following prayers:

(i). That the Respondents may kindly be directed to regularize the services of the Petitioner wef due date, ie 112005, when the Petitioner has completed 8 years of service on daily wage basis, as per the policy of state Govt. and also as per the decision rendered by this Hon''ble Court in case titled as Man Singh v. State of H.P. in C.W.P. No. 1594/2008.

(ii) That the Respondents may further be directed to give the all consequential benefits in favour of the Petitioner wef 112005 till the date of realization along with interest @ 18% per annum.

It is submitted by the learned Counsel for the Petitioners that the cases are squarely covered by the decision of this Court rendered in CWP No. 1594 of 2008 titled as Man Singh v. State of H.P. and Ors.

Learned Deputy Advocate General points out that the factual aspects are to be verified by the competent authority. Petitioners submit that they would file appropriate representation(s) furnishing all factual details before the competent authority within a period of one month from today. It is always open for them to do so.

Therefore, in the event of the Petitioners approaching the first Respondent within a period of one month, the matter will be duly considered by the first Respondent/competent authority in the light of the judgment, referred to above and appropriate action in accordance with law will be taken within another four months from the date of receipt of the representation(s) along with a copy of this judgment and the copy of the judgment, referred to above.

The writ petitions are disposed of, so also the pending applications, if any.
