The petitioners are accused in a case registered u/s 7 of the Essential commodities Act. It reveals from the written report that kerosene oil vendors were indulged in black marketing and the respective carts with kerosene oil were seized from a place which was not notified for them to sell.
It is submitted that co-accused Shanti Devi having similar allegation, has been granted anticipatory bail vide A.B.A. No. 1401 of 2012 by order dated 10.5.2012 passed by a Bench of this Court.
Learned Counsel, appearing for the State, does not dispute this situation. Considering the fact that co-accused, having similar allegation, has been granted anticipatory, the petitioners, named above, are also directed to surrender in the court below within three weeks from today and on such surrender, they shall be released on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) each with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Hazaribagh in connection with Hazaribagh (Sadar) P.S. Case No. 37 of 2012 (G.R. Case No. 181 of 2012), subject to the conditions as laid down u/s 438(2) of the Code of Criminal Procedure.
