Judgment
The petitioner has been arrested in connection with FIR No.100/2019, Police Station Khedapa, District Jodhpur Rural for the offence punishable under
Sections 8/15, 25 & 29 of NDPS Act and Sections 307, 323, 353, 420, 467, 468 & 471 of IPC. He has preferred this interim bail application under
Section 439 Cr.P.C.
Heard learned counsel for the petitioner as well as learned Public Prosecutor and also perused the material on record.
Learned counsel for the petitioner submits that the petitioner’s wife is on the family-way and the delivery is expected to be in the period between
26.02.2020 to 07.03.2020.
On verification being done by learned Public Prosecutor, it is found that the fact of delivery is not disputed.
Having regard to the totality of the facts and circumstances of the case and the fact that the petitioner’s wife is on the family-way, I deem it just
and proper to grant interim bail to the accused petitioner under Section 439 Cr.P.C. for a period of ten(10) days from custody on 27.02.2020 to
07.03.2020.
Accordingly, the present interim bail application filed under Section 439 Cr.P.C. is allowed and it is directed that petitioner Mahiram S/o Shri Prem
Chand may be released on interim bail for a period of aforesaid ten days provided he furnishes a personal bond in the sum of Rs.2,00,000/- (Rupees:
Two Lac Only) along with two sureties of Rs.1,00,000/- (Rupees: One Lac Only) (out of which, one of the surety will be of a close family member)
each to the satisfaction of the trial court. The petitioner shall surrender before the Superintendent of Police, Central Jail, Jodhpur on 07.03.2020.
