Judgment
The present second interim bail application has been filed by the petitioner under Section 439 Cr.P.C. The petitioner has been arrested in connection with FIR No.190/2020 Registered at Police Station Salempur, Dausa for the offences under Section 8/21 of N.D.P.S. Act.
Counsel for the petitioner submits that the marriage of his cousin sister is going to be solemnized on 15.03.2021 and prayed that the petitioner be released on interim bail for a period of ten days.
Learned Public Prosecutor though has confirmed the fact regarding the marriage of his cousin sister but opposed the prayer for interim bail.
Considering the submissions put-forth by counsel for the parties and taking into account the facts and circumstances of the present case and also considering the fact that the recovered contraband article is less than the commercial quantity and without expressing any opinion on merits of the case, I deem it just and proper to release the petitioner on interim bail for a period of 10 days from today.
Accordingly, it is ordered that the accused-petitioner Premsingh S/o Mohar Singh shall be released on interim bail provided he furnishes a personal bond in the sum of Rs.50,000/- along with two sureties of Rs.25,000/- each to the satisfaction of the learned trial court with the stipulation to surrender before the concerned Jail Authorities on 21.03.2021 itself.
List again on 23.03.2021.
