In the present writ petition, the petitioner is praying for issuance of a direction to the respondents to count the military service rendered by the petitioner from 07.01.1973 to 09.12.1978 i.e. during the second national emergency for the purpose of increments and pensionary benefits in terms of Punjab Recruitment of Ex-Servicemen Rules, 1982.

Learned counsel appearing on behalf of the petitioner, on instructions from the petitioner, submits that at this stage, he will be satisfied if a direction is given to respondent No.1 to decide the legal notice dated 01.01.2026 (Annexure P-8) submitted by the petitioner, in a time bound manner.

Mr. Rohit Ahuja, DAG, Punjab, accepts notice on behalf of the respondents and does not object to the prayer made by learned counsel for the petitioner.

In view of the above and without commenting upon the merits of the case, this petition is hereby disposed of with a direction to respondent No.1 to decide the legal notice dated 01.01.2026 (Annexure P-8), submitted by the petitioner within a period of 03 months from the date of receipt of certified copy of this order, in accordance with law. In case, the petitioner is held entitled for grant of relief as claimed by him in the legal notice, as per the law/rules, the same be also released within a period of 01 month thereafter. In case the claim of the petitioner is not accepted, a speaking order be passed and copy of the same be supplied to the petitioner.
