This is an office reference.
This Court, vide order dated 03.05.2024, passed in MCRC No. 3210 of 2024, while rejecting the bail to the applicant, namely, Mahboob Khan, had expressed its trust that the trial Court should make an earnest endeavor to conclude the trial expeditiously in accordance with law, preferably within a period of six months from the date of receipt of a certified copy of the order, if there was no legal impediment.
The learned Special Judge (NDPS Act), Baikunthpur District-Koriya, (C.G.) vide his request letter dated 14.11.2024 has requested for grant of one month time for concluding the trial.
It transpires from perusal of the PUD, that in this case, statements of 12 prosecution witnesses have been recorded. There are total 15 accused persons in the present case and the statements of the accused are ready. The only remaining steps are to hear the final arguments and pass a judgment. However, due to the absence of accused Sohel Ansari, his statement could not be recorded. Hence, the conclusion of the trial is likely to take some time for its conclusion.
The request appears to be reasonable. The concerned trial Court is directed to conclude the trial as early as possible, preferably within a further period of one month from the date of receipt of a certified copy of this order.
Accordingly, this CRMP stands disposed off with the aforesaid direction.
Registry is directed to send a certified copy of this order to the trial Court concerned for necessary information and compliance.
