Judgment
By filing this writ petition, the petitioner has prayed for the following reliefs:-
"(A)For issuance of an appropriate writ or writs in the nature of mandamus directing the respondents to make payment of admitted dues of Rs.1,86,81,038/- pursuant to construction of conference hall-cum lecture block at faculty of forestry under Birsa Agriculture University, Kanke, Ranchi which has been awarded in favour of the petitioner pursuant to agreement no.46/F2/BAU/State Scheme/2018-2019 dated 07.09.2019 inasmuch as the petitioner has already completed the construction of conference hall-cum-lecture block at faculty of building within the stipulated time period and handed over the possession of the same to the respondent on 29.06.2022 but in spite of repeated request no payment has been released by the respondents till date;
(B)For issuance of an appropriate writ(s)/ order(s)/ direction(s) for a declaration that Petitioner is entitled for the payment of Rs.1,86,81,038/- pursuant to construction of conference hall-cum lecture block at faculty of forestry under Birsa Agriculture University, Kanke, Ranchi which has been awarded in favour of the petitioner pursuant to agreement no.46/F2/BAU/State Scheme/2018-2019 dated 07.09.2019.
(C)For issuance of an appropriate writ(s)/ order(s)/ direction(s) for release of admitted dues of Rs.1,86,81,038/- along with interest @ 18% per annum from the date of actual payment towards construction of conference hall-cum lecture block at faculty of forestry under Birsa Agriculture University, Kanke, Ranchi in terms of agreement no.46/F2/BAU/State Scheme/2018-2019 dated 07.09.2019.”
Heard learned counsel representing the petitioner, learned counsel representing the respondent - State and learned senior counsel representing the respondent – Birsa Agriculture University (BAU), Ranchi.
The petitioner – Firm claimed Rs.1,87,03,826/- as its dues. Admittedly, during pendency of this writ petition, Rs.1,83,75,638/- out of the aforesaid amount, had already been paid to the petitioner - Firm. The balance amount is now Rs.3,28,188/-.
It is the case of the respondents that immediately after opening of the conference hall, the false ceiling collapsed.
The petitioner – Firm, in rebuttal contends that restoration of the false ceiling has already been done.
Considering the aforesaid fact, since Rs.3,28,188/-, is due, I direct the petitioner – Firm to approach the Vice Chancellor, BAU, Ranchi, by filing a representation claiming the balance amount.
The Vice Chancellor, BAU, Ranchi, will consider the claim of the petitioner - Firm and if it is found that the petitioner -Firm is entitled for the balance amount, the same be disbursed to the petitioner - Firm, within a period of eight weeks.
So far as the interest is concerned, it will be open to the petitioner – Firm, to claim the same.
With the aforesaid direction and observation, this writ petition stands disposed of.
