The petitioner is apprehending his arrest in connection with the case register under Sections 467, 468, 471, 420 of the Indian Penal Code.

The brief fact of the case is that one Dilip Kumar Manjhi, Education Officer, Dhanbad in terms of the letter No.3555, dated 4.10.2016, issued by the District Education Officer, Dhanbad, was assigned a duty for verification of the documents including education certificates of the candidates who qualified for the post of Assistant Teacher. That after verification, the Intermediate certificate of the petitioner issued by the JAC who is at serial no.11 in the list of qualified candidates was found to be forged.

On the basis of the aforesaid facts, the present case has been lodged.

Learned counsel for the petitioner has submitted that the petitioner is innocent and has been falsely implicated in this case. That the certificate issued by the Jharkhand Academic Council in the name of the petitioner is genuine and as such, his appointment as a teacher in Government of Jharkhand is not on the basis of forged and fabricated document. It is further submitted that the certificate dated 1.09.2003, being No. JIEC/CERT/047782, issued by the JAC in the name of the petitioner, is annexed as Annexure -2.

Learned APP has opposed the prayer for bail and submitted that as per Para-24 of the case diary, I.O has verified the said certificate and has found the same to be forged and it was not found to be issued by the Jharkhand Academic Council.

In view of the fact that the investigation is still going on, I am not inclined to admit the petitioner on anticipatory bail. Accordingly, this anticipatory bail application stands dismissed.
