Judgment
Heard the learned counsels appearing for the parties and perused the documents on record.
The petitioner has been made an accused in Taljhari P. S. Case No.61 of 2014 which was registered for the offences under Section 366, 498, 380, 120 (B) I.P.C. The complainant instituted P.C.R. Case No.189 of 2014 which was referred under Section 156 (3) Cr.P.C ., on the basis of which aforesaid case has been registered on 15.06.2014. The complainant is husband of one Saniya Devi who has made allegation against the petitioner that he eloped with said Saniya Devi. The accused persons have claimed that the complainant himself has contracted second marriage with one Chaitali Devi, daughter of Kailash Dholi and when co-accused Saniya Devi opposed, the instant case has been lodged by him. The petitioner is in judicial custody since 13.02.2017.
Case-diary has been received by the learned APP who has opposed the prayer for grant of bail.
Having regard to the facts and circumstances of the case, the petitioner, above-named, is directed to be released on bail on furnishing bail bond of Rs.10,000/-(Rupees ten thousand) with two sureties of the like amount each to the satisfaction of the learned A.C.J.M., Rajmahal in connection with Taljhari P.S. Case No.61 of 2014, corresponding to G.R. No.321 of 2014.
The instant application is allowed. Let a copy of the order be transmitted to the trial Court through ''Fax''.
