This is a petition for extension of time by granting five months for carrying out the directions given by the Hon'ble High Court in the judgment dated 29-04-2020 passed in W.P. No.19393/2019 ( Shivendra Singh Parihar & Ors. vs. The State of Madhya Pradesh & Ors.).
The applicant Madhya Pradesh Public Service Commission has filed the present petition seeking extension of time to comply with the directions passed by this Court contained in para-29 of the order, which reads as under :-
"In view of the aforesaid enunciation of law, it is elucidated that the quota for PH has to be computed on the basis of sanctioned strength and not on the basis of vacancies notified alone. In other words, the PH quota shall be counted on the basis of the posts of the cadre already filled and the vacancies notified. The computation of PH quota in the revised advertisement dated 19.8.2019 is, thus, erroneous. The respondents are directed to redraw the list of PH candidates after revising the quota by computing the posts on the basis of total vacancies in the cadre strength of the cadre and thereafter to proceed for appointment in accordance with law expeditiously, preferably within a period of one month from the date of receipt of the copy of the order passed today."
It is urged that due to Pandemic COVID-19, nationwide lockdown was imposed, as a result of which all the institutions were closed and therefore the directions passed by this Court could not be complied with. It is further stated that till today lockdown has not been lifted in entirety and is still continuing with certain relaxation. Resultantly, the office of the applicant is not working in full staff strength. Therefore, in the interest of justice, five months' time may be granted for complying the directions of this Court.
The present application was filed on 06.6.2020 and thus a period of more than three and a half months has already lapsed, however, in the interest of justice, keeping in view the peculiar situation of Pandemic COVID-19, time is extended upto 31.12.2020 to carry out the directions issued by this Court with a rider that no further extension shall be granted.
Accordingly, this MCC stands disposed of.
