Madhuri Topo vs The State of Jharkhand

D.K. Sinha, J.—The Petitioner, Madhuri Topo apprehend her arrest in Gumla P.S. Case No. 267 of 2010 corresponding to G.R. No. 820

of 2010 now pending before the Learned Chief Judicial Magistrate, Gumla for the alleged offence u/s 420,461,462,466,467,468,471/120B of the

I.P.C. The only allegation against the Petitioner is that in a mutation case, though the Circle Officer, Gumla had directed that plot No. 1153 be

mutated , but Petitioner had corrected and typed the mutation of plot No. 1853 with ulterior motive.

Mr. Nilesh Kumar, learned Counsel for the Petitioner submitted that an appeal was preferred before the Deputy Collector, Land Reforms,

Gumla in Misc. Case No. 9/09-10 where in it was held vide annexue-2 page 15 that plot No. 1853 of khata No. 69 was the correct number and

on account of error on the part of the typist it was typed as plot No. 1153 in the order of the Circle Officer. Nowhere the Petitioner was alleged

that she intentionally and malafidely committed such error rather she bonafidely corrected it by putting the correct plot number in the order of the

Circle Officer, Gumla which was approved by Deputy Collector, Land Reforms as aforesaid

Under the facts and circumstances, in the event of her arrest or surrender within 15 days of this order, the Petitioner, Madhuri Topo is directed

to be released on executing bail bond of Rs. 15,000/-(Fifteen Thousand) with two sureties of the like amount each to the satisfaction of the

Learned Chief Judicial Magistrate, Gumla in connection with Gumla P.S. Case No. 267 of 2010 corresponding to G.R. Case No. 820 of 2010

subject to the conditions as laid down u/s 438(2) of the Code of Criminal Procedure.
