The applicant is working as Assistant Manager (Marketing) in Mahanagar Telephone Nigam Limited (MTNL). He submitted a representation

stating that he was not paid salary for the months of September and October, 2020. Through a communication dated 18.11.2020, the respondents

informed the applicant that the salary was not paid on account of the fact that he remained absent and the particulars of his attendance were not

received. The said communication is challenged in this O.A.

The applicant contends that it was the duty of the respondents to gather the particulars of the attendance and they are under obligation to pay the

salary.

Earlier the O.A. was listed on 11.01.2021 and the applicant sought time till 22.01.2021. Thereafter, the O.A. was listed but the applicant did not turn

up. Today also, there is no representation on behalf of the applicant. We perused the record.

The only basis for not paying the salary of the applicant for the months of September and October, 2020 is that he remained absent during that

period. In case the applicant has any record to show that he attended the duty during that period, he can submit the same to the respondents. If it

emerges that the applicant worked for the entire period of September and October, 2020 or any part thereof, the respondents can verify the same and

take necessary steps.

We, therefore, dispose of the O.A. leaving it open to the applicant to submit the particulars of his attendance to the respondents within four weeks

from the date of receipt of a copy of this order. As and when such particulars are submitted by the applicant, the respondents shall take necessary

steps, in accordance with law.

There shall be no order as to costs.
