Judgment

The applicant filed this OA feeling aggrieved by denial of promotion to the post of Assistant Chief Accountant in the respondent organization. It is pleaded that though she was considered alongwith others by the DPC, her case was not recommended, and she was wrongfully denied the promotion.
We heard Shri Padma Kumar S., learned counsel for the applicant. None is present on behalf of the respondents.
During the pendency of the OA, it so emerged that the case of the applicant was deferred by the DPC on account of non-availability of ACRs, and once they were traced, she has been promoted immediately, with effect from 27.04.2012. With this, the grievance of the applicant stands redressed to a substantive extent. The only question that remains would be about her entitlement to be promoted with effect from the date on which her juniors were promoted. The applicant can make a representation in this regard.
We, therefore, dispose of the OA taking note of the fact that the applicant has already been promoted to the post of Assistant Chief Accountant, and leaving it open to her to make a representation, as regards the effective date of promotion. In case the applicant makes a representation in this behalf, the same shall be considered and appropriate orders be passed, within a period of two months thereafter.
There shall be no order as to costs.
