Counsel for the respondents submitted that the service of the petitioner has been regularized vide order dated 29th July, 2011. Photocopy of the said order is taken on record and copy of the same shall be handed over to the counsel for the petitioner. Counsel for the petitioner submitted that so far this grievance is concerned, the petition does not survive, but liberty may be reserved with the petitioner to file representation for getting salary for the period running from October, 2005 onwards for the work he has done as a daily wager. The representation will be preferred before the respondent No.2 and let a direction be given to respondent No.2 to decide the representation in accordance with law, within the stipulated time, as given by this Court.
In view of this submission, so far the grievance of the petitioner with regard to regularization of service, it has been brought to an end by the aforesaid order dated 29th July, 2011. So far payment of salary of the petitioner as a Daily Wager from October, 2005 onwards is concerned, liberty is reserved with the petitioner to prefer a representation before the respondent No.2 with proper averments, allegation and annexures and the respondent No.2 is hereby directed to decide the same in accordance with law, rules, regulations, policies and Government enforceable orders, applicable to the petitioner as expeditiously as possible and practicable, preferably within a period of eight weeks, from the date of receipt of the representation. If the decision is taken in favour of the petitioner, the benefit of the decision will be extended to the petitioner within a further period of four weeks thereafter.
In view of the above directions, this writ petition is disposed of.
