Judgment
ORDER
This Transfer Petition is filed seeking transfer of SA NDN 1845/2024, pending on the file of DRT, Coimbatore to DRT, Madurai.
It is submitted by Leaned Counsel for Applicants that SA 808/2024, between the same parties, filed before DRT, Coimbatore was transferred to DRT, Madurai on the ground that Mr. N. Somasundaar, Learned Presiding Officer, DRT, Coimbatore had earlier represented Respondent Bank as a panel Advocate. Learned Presiding Officer, himself passed an order on 24.12.2025 directing the parties to take steps to transfer the SA to some other Tribunal. On that basis, SA 808/2024 was transferred from DRT, Coimbatore to DRT, Madurai.
It is submitted that the present SA NDN 1845/2024 is between the same parties and to avoid the conflict of interest, it is prayed that this SA may also be transferred to be tried along with SA 808/2024.
In the said circumstances stated and taking into consideration the transfer of SA 808/2024 between the same parties, from DRT, Coimbatore to DRT, Madurai, the SA NDN 1845/2024 is transferred to DRT, Madurai, for disposal.
The Registry DRT, Coimbatore is directed to send the records in SA NDN 1845/2024 with proper index to the DRT, Madurai, within a period of two weeks from the date of receipt of copy of this order. On receipt of the documents in SA NDN 1845/2024, Learned Presiding Officer, DRT-Madurai, shall decide SA NDN 1845/2024, on merits and in accordance with law, after giving opportunity to both parties, as expeditiously as possible.
In the result: Application in T.P:22/2025 is allowed. Both the parties shall bear their own costs. All pending IAs, if any, stand closed.
