Judgment
ORDER
This petition is filed for transfer of SA 528/2024 pending on the file of DRT, Coimbatore to any other DRT at Chennai or Madurai, within the jurisdiction of DRAT, Chennai.
Learned counsel for the petitioners submitted that Mr. N. Somasundaar, learned Presiding Officer, DRT, Coimbatore, had earlier represented the respondents/Bank as a panel Advocate and thus, the learned Presiding Officer, himself, by an order dated 17.06.2025 gave a direction to the parties to take steps to transfer this SA 528/2024 to some other Tribunal since the learned Presiding Officer had represented the respondents/Bank as a panel lawyer in the Hon’ble High Court of Madras. Therefore, this transfer petition is filed.
Learned counsel for the respondents/Bank submitted that they have no objection for transferring SA 528/2024 to any one of the DRTs in Chennai.
In the said circumstances, since the DRT, Madurai, is nearer to DRT, Coimbatore, this Tribunal directs that SA 528/2024 is to be transferred to DRT, Madurai.
The learned Presiding Officer, DRT, Coimbatore is directed to send the records to DRT, Madurai within a period two weeks from the date of receipt of a copy of this order. On receipt of all the records, the learned Presiding Officer, DRT, Madurai, is directed to assign a new Number and dispose the case as expeditiously as possible on merits and in accordance with law.
In the result, this TP 16/2025 is ordered accordingly.
Parties shall bear their own costs.
