Mr. Justice L. Narasimha Reddy, Chairman :-

The applicant was appointed as PGT (Chemistry) in the Kendriya Vidhyalaya Sangathan (KVS) in the year 2017. She joined the post on 25.07.2018. The applicant was posted in an Institution at Dholchera (Assam). Representations were made successively every year with a request to transfer her to an Institution near Shimla, where her husband is working. Her request was not acceded to on the ground that the vacancies were not available. Recently she made a representation duly stating that the vacancies were available but the respondents did not take any action on the representations.

We heard Mr. Yogesh Sharma, learned counsel for applicant and Mr. S. Rajappa, learned counsel for respondents.

The respondents have their own policy regarding transfer of an employee to get transferred to a particular place. Two attempts made by the applicant to get transferred to an Institute where her husband is working were not fructified on account of the reason that there was no vacancy. The applicant renewed the request with a new representation that the vacancies are available and since the applicant fits into the policy guidelines relief need to be granted. The result of the consideration of the representation needs to be conveyed to the applicant.

We therefore, dispose of the O.A directing the respondents to pass orders on the representation dated 03.11.2020 submitted by the applicant within a period of four weeks from the date of receipt of a copy of this order.
