ORDER
CA 1010/2019 has been filed by the statutory auditor praying for cancellation of Non-Bailable Warrants issued against him. It is considered equitable to recall the same. He is however directed to be present in court as and when his presence is required before this Bench. Mr. Sahil Garg, Ld. Counsel representing him undertakes that the applicant shall be present as and when summoned. Accordingly, non-bailable warrants are hereby recalled. Copy of the order be given Dasti.
It appears that there is certain discrepancy in respect of the immovable property reflected in the balance sheet. The RP submits that the conveyance deed in this case has not been executed despite the fact that the sale consideration has been paid from the account of the Corporate Debtor. The Ex-Directors have not appeared before this court despite Non-Bailable Warrants. No action has been taken through the office of the Sr. Superintendent of Police. Fresh Non-Bailable Warrants be issued for Mr. Surinder Kumar Bindal, S/o Shri Bishamer Dayal, H. No. 394, Sector 14, Karnal-132001 (Haryana); Email ID: [email protected] and [email protected] ; Mr. Sumit Kumar Bindal, S/o Shri Surinder Kumar Bindal, H. No. 394, Sector 14, Karnal-132001 (Haryana); Email ID: [email protected] and [email protected]. The said Non-Bailable Warrants also be given by the Registry to the RP for necessary execution. Dasti List this case for further consideration on 19th September, 2019.
This Bench has also been apprised that 270 days of the CIR process shall expire on 30th September, 2019 and the resolution plan received shall be put up for consideration before the COC shortly.
The RP is directed to take steps towards the corporate resolution as expeditiously as possible.
