The instant application is filed for the Transfer of T.A. bearing no.446/2022 titled as National Assets Reconstruction Company Limited V M/s SSA International Limited & others which is pending before DRT-III, Delhi.

Sh. A.K.D. Sayare, Advocate for the applicants argued that the applicants are not likely to get justice from DRT-III, Delhi. During the course of arguments the counsel for the applicants referred various orders passed by DRT-III, Delhi. It is also argued that DRT-III, Delhi has imposed costs and also passed direction to close the defence of the applicants if the cost is not paid. It is vehemently argued that the applicants are not expecting proper justice from DRT-III, Delhi and accordingly prayed for transfer of the O.A. bearing T.A. No.446/2022.

Sh. Amrendra Kumar Singh, Advocate appearing on behalf of the respondent no.1 stated that huge amount of public money is recoverable from the applicants and the O.A. is at the final stage before DRT. It is further argued that from time to time the applicants have resorted to and pursued their remedy and in case any adverse order is passed by DRT-III, Delhi against the applicants, they can avail remedy available to them in law.

After considering the submissions as noted herein above on behalf of the parties, this Tribunal finds no ground for transfer of the O.A bearing T.A. No.446/2022 from DRT-III, Delhi. Accordingly, the application is dismissed.
