Judgment
This is a Transfer Petition No. 02 of 2026 filed by Applicant herein who is the Respondent in S.A. No. 106/2024 pending before DRT-I, Mumbai.
Learned Counsel for the Applicant would submit that vide order dated 23.12.2025, the learned Chairperson Incharge of DRAT, Mumbai had directed the DRT-I, Mumbai to dispose of the stay application (I.A. No. 2354/2025) on or before 07.01.2026; however, the said application has not been decided till today.
Learned Counsel for the Applicant would further submit, on query of the Appellate Tribunal, that there is no personal imputation as against the Presiding Officer.
In view of the above submissions, there is no reason to transfer the case. However, at the same time, the DRT-I, Mumbai is requested to dispose of the stay application (I.A. No. 2354/2025) by earliest in view of the fact that the learned Chairperson Incharge had already directed to decide the said I.A. by 07.01.2026.
Accordingly, Transfer Petition No. 02/2026 is disposed of.
