Judgment
ORDER:
This Writ Petition is filed to declare the inaction of respondents in not releasing the bills of Rs.81,93,647.23 for the period 08.08.2024 to 28.02.2025 for loading the stock coal for the work done under the Firm Order No.7500054346 dated 21.06.2024 and also further direct the respondents to release the said bills.
Heard Sri V.Murli Manohar, learned counsel for the petitioner and Mr.P.Sri Harsha Reddy, learned Standing Counsel for Singareni Collieries appearing on behalf of respondents. Perused the record.
The facts of the case as stated are that respondent No.1 has allotted a Firm Order No.7500054346 for providing 4.6 cub.mtr capacity Tyre Mounted Front End Loader on hire basis. Subsequently, petitioner purchased the said loader by availing credit from the financiers and paying the same in Equal Monthly Instalments. The petitioner deployed the said loader for a period of 7 months with the respondents and carried out 4305 hours of work and submitted invoices of Rs.81,93,647.23 ps. However, the respondent authorities miscalculated and arrived at 1820 hours of work instead of 4305 hours. Thereafter, the petitioner has submitted a representation dated 08.07.2026 to the CMD explaining the aforesaid situation. Since, no response was forthcoming, the present writ petition is filed.
A memo along with affidavit of undertaking has been filed by the petitioner stating that petitioner is ready and willing to resume and continue the work as per the tender within sixty days from the date of release of payment, if the respondent so desires subject to the revision of the diesel rates. Along with the said Memo a letter dated 08.07.2026 was enclosed which was addressed by the petitioner to the respondent authorities wherein the details of all the documents submitted to the respondent authorities have been mentioned.
At this, learned standing counsel for the respondents would submit that respondent authorities are yet to receive all the relevant documents to be produced by the petitioner for release of aggrieved bills.
Having regard to the submissions made above, this writ petition is disposed of with a direction to respondent authorities to process the petitioner's pending bills subject to petitioner producing all the relevant and necessary documents. The said exercise shall be completed within a period of four (4) weeks from the date of submission of all the relevant and necessary documents. No costs.
Accordingly, this writ petition is disposed of.
Miscellaneous applications, if any pending, shall stand closed.
