Judgment
Counsel for Resolution Professional is present. It is submitted that vide order dated 21st November 2019 passed by the Hon'ble NCLAT in Company Appeal No. 710 of 2019 has set aside the order impugned and directed this Tribunal to close the main petition i.e. IB 464 of 2017. Therefore, the main petition stands closed.
The order dated 21st November 2019 passed by the Hon'ble NCLAT further provides that the Interim Resolution Professional/RP will hand over the assets and the record of the company to the Promoter/Board of Directors of the Corporate Debtor viz. M/s. Jeevan Jyoti Vanijya Ltd. and the fee of IRP /RP and the CIRP cost incurred will be settled up by this authority which will be paid by the Financial Creditor, who has initiated Section 7/application. Therefore, registry is directed to issue notice to the Financial Creditor viz. M/s Nimit Builders Pvt. Ltd. The Resolution Professional is directed to sent private notice at the registered office address of the respondent by all modes and file proof of service with affidavit.
