ORDER

Ld. Counsel for Committee of Creditors, for Corporate Debtor, Ld. IRP and Ld. RP are present.

Ld. Counsel on the side of the Corporate Debtor brought to my notice the order of Hon'ble Appellate Tribunal in Company Appeal (AT)(Insolvency) No.482 of 2018 that Appellate Tribunal has set aside the order of admission with a direction read as follows:-

"the fee of 'Interim Resolution Professional' and the 'Corporate Debtor' will pay the fees of the 'Interim Resolution Professional' for the period he has functioned. The appeal is allowed with aforesaid observation. However, in the facts and circumstances of the case, there shall be no order as to cost"

Therefore, vide direction of the Hon'ble Appellate Tribunal, the proceedings is hereby closed.

IRP has submitted that memo of cost has already been submitted to the Corporate Debtor. The Corporate Debtor is therefore, directed to consider and decide accordingly. If the Corporate Debtor is satisfied with the demand of fees by the IRP, directed to pay the fees demanded within one week.

Interim application, if any, is pending stands disposed of.

List it for hearing on 13.02.2019 regarding fixation of IRP fees, if any.
