Judgment
Appellants filed S.A. bearing no.616/2025 titled as N.K. Fabrics & another V. Bank of Baroda & others which is stated to be pending before DRT, Jaipur. DRT, Jaipur vide the impugned order dated 17.07.2026 has made clear that there was no interim order passed in the S.A. bearing no.616/2025. The order dated 17.07.2026 reads as under:-
In this matter, compliance of the orders has not been made. Counsel for the applicant submits that through he has instructed the party to comply, but they have failed to do so. He requests that the matter be heard on merits.
It is made clear that there are no interim orders in this matter.
List the matter before Registrar for completion of pleadings on 14.10.2026.
Sh. Ankit Acharya, Advocate for the appellants stated that DRT, Jaipur has not considered grant of interim relief which was prayed for in S.A. bearing no.6167/2025 and the case has been ordered to be listed on 14.10.2026 before the Registrar for completion of pleadings. It is further stated that the subject property is a residential property of the appellants from which the appellants would be dispossessed in case interim relief is not granted to the appellants.
The impugned order dated 17.07.2026 reflects that DRT has listed the matter for 14.10.2026 without considering the plea of the appellants for grant of interim injunction. In the circumstance, the appellants are directed to appear before DRT, Jaipur on 04.08.2026 and DRT, Jaipur is directed to consider and decide the prayer of the appellants for grant of interim relief on the said date or any other date to be fixed by it but not later than one week. In case of any grievance against the order passed by the DRT, the appellants shall be at liberty to initiate legal proceedings before appropriate forum.
With the above direction, the appeal stands disposed of.
Copy of this order be given dasti to the appellant and be sent to the DRT concerned for compliance.
