Judgment
The appellant filed S.A. bearing No. 189/2025 titled as Jitender Arora V. Truhome Finance Limited & others which is stated to be pending before the DRT-II, Delhi.DRT-II, Delhi vide order dated 26.06.2025 directed the Registry to issue notice to the respondents no. 2 to 4 and Ms. Usha Singh, appeared for respondent no. 1 before DRT-II, Delhi and accepted notice. The DRT-II, Delhi also took note of the submissions made by respondent no.1 that the physical possession of the subject property had already been taken.
The counsel for the appellant stated that the appellant has made prayer for interim relief in the Securitization Application (S.A.) but it was not considered by the DRT-II, Delhi. It is appearing from the impugned order dated 23.06.2025 that the prayer for interim relief was not considered by the DRT-II, Delhi. Accordingly, the present appeal is disposed of with the direction to the DRT-II, Delhi to consider the interim relief as prayed for in the S.A. in accordance with law.
The counsel for the appellant also informed that an application for grant of interim stay has already been filed before the DRT-II, Delhi. The DRT-II, Delhi is also directed to consider the said application in accordance with law and to give suitable judicial determination on the said application.
The pending application, if any, also stands disposed of.
