Judgment
This Comp. App (AT) (CH) (INS) No. 149 / 2024, was finally heard by Three Member Bench of this Tribunal and was permitted to be dismissed as withdrawn, subject to certain liberties which were reserved to be granted therein. But, the Order of 29.04.2024, could not be uploaded for the reason being that Order could not be transcribed in time for one of the Hon’ble Members, to sign the same as he demitted his Office, in the meanwhile. Hence, the matter has been placed before this Tribunal for its re-consideration. This Comp. App (AT) (CH) (INS) No. 149 / 2024, would stand disposed of, in terms of the Order, which was passed on 29.04.2024, which is extracted hereunder:
``The Learned Counsel for the ‘Appellant’ is permitted to withdraw the instant Comp. App (AT)(CH)(Ins) No.149 of 2024. Acceding to the said request, the instant Comp. App. (AT)(CH)(Ins) No.149 of 2024 is ‘Dismissed as Withdrawn’. No costs.
Before parting with the case, this ‘Tribunal’ grants liberty to the ‘Appellant’ to prefer an ‘Interlocutory Application, before the ‘Adjudicating Authority/Tribunal’ seeking early hearing of IA No.785/2024, which is to come up on 06.05.2024 within two days from today. In the event of the ‘Appellant’ filing the said ‘Interlocutory Application’ before the ‘Adjudicating Authority’/‘Tribunal’ within two days from today, then the ‘Adjudicating Authority/Tribunal’ shall scrutinize the same and assign number to the said ‘Application’ and to bring before it for ‘Hearing’ and after listing of the matter, to Hear both the parties on merits and to pass orders, keeping in mind, the ‘Principles of Natural Justice’ by providing a ‘fair’ and ‘just’ ‘Hearing’, the Learned Counsel’s appearing for the Parties. Liberty is granted to the respective sides through the Learned Counsel’s to raise all factual and legal pleas before the ‘Adjudicating Authority/Tribunal’ in the new ‘Interlocutory Application’ to be filed by the ‘Appellant’/‘Petitioner’ and the ‘Adjudicating Authority’/‘Tribunal’ shall take note of the same, and to deal with it, of course, in the manner known to law and in accordance with law, if so desires/advise.’’
