The appellants filed S.A. bearing No.486/2017 titled as M/s Jullundur Engineering Company & another V Andhra Bank & others. During the pendency of said S.A. the appellants also filed an interim application bearing I.A. No.138/2020 which was dismissed vide impugned order dated 13.05.2022.

Sh. Akhilesh Vyas, Advocate for auction purchaser and Sh. S.K. Sharma, Advocate for respondent no.1 stated that the S.A. bearing No.486/2017 has already been dismissed vide impugned order dated 13.03.2024 and to impugn the order dated 13.03.2024 the appellant has already filed an appeal bearing No. 178/2026 and which is listed before this Tribunal on 20.08.2026. 3.Ms. Niharika Ahluwalia, Advocate for the appellant stated that the present appeal may be adjourned for 20.08.2026 so that the present appeal can be heard along with appeal bearing No.178/2026.

In view of the submissions made by the counsels for the parties, it is observed that the S.A. bearing No.486/2017 has already been disposed of finally vide order dated 13.03.2024 and as such the present appeal being arisen from an interim order does not require further adjudication and is accordingly, disposed of. However, the liberty is granted to the appellant to apply for the revival of the present appeal in case of altered circumstances.
