Company Petition No. IB No. 311(ND) 2019an application under Section 60(5) of IBC, 2016 read with Rule 11 of NCLT Rules 2016 for withdrawal of the application and for recording the settlement between the parties has been placed before this Tribunal today. We understand that the application has already been moved in the Registry, but has not reached in the Tribunal. It contains Diary No. 0710102156852019 dated 29.11.2019. Perused the contents of the application. The IRP is present and reports that COC has not yet been constituted. Having regard to the submissions made by the IRP and the parties that the matter has been amicably resolved between the parties within next couple of days, this Tribunal in exercise of its powers allows the application. The application is disposed of and the matter is treated as withdrawn. Liberty is also granted to the Operational-creditor to revive the application if the post-dated cheques given are dishonoured. The IRP fees may be paid. The requirement of public announcement is also exempted at the request of the IRP in the matter.
