M/s. G. H. Prints Private Limited vs M/s. Mode Advertising & Marketing Private Limited

Mr. Pawan Sharma, Ld. Counsel has appeared on behalf of the Ex-Director and has apologised for not appearing before this Bench. In an earlier proceeding, the CIR process had been admitted against them. As the Respondent did not appear before this court to apprise that the CIR was admitted, the present petition was Admitted and an IRP was appointed. The Corporate Debtor had also filed an appeal impugning the first order of Admission by the Hon'ble NCLAT. It is submitted that Hon'ble NCLAT has stayed further convening of the COC and the CD is in the process of settling the claim of the present claimant as well as the petitioner in earlier petition. Mr. Gautam Singhal appointed as the IRP in the 1st matter i.e. M/s. Famous Innovations Digital Creative Pvt. Ltd. V/s. M/s. Mode Advertising & Marketing Private Limited is present in court. In view of the same, our order of Admission in the present case has become infructuous. The IRP appointed in the present case is hereby discharged. The Corporate Debtor is directed to compensate the expenses and professional fees of the IRP.

The matter stands disposed off.
