I.A. No.370/2024 (Application for waiver of pre-deposit)

Sh. Arvind Sharma, Advocate for the applicant stated that in compliance of previous orders passed by this Tribunal, the appellant has already deposited Rs.5,85,000/- which is 25% of the decretal amount of Rs. 23,35,231.92. The requirement of pre-deposit is complied with.

Accordingly, the application stands disposed of.

I.A. No.369/2024 (Application for condonation of delay)

The instant application is filed to condone the delay of 60 days in filing the present appeal. Sh. Arvind Sharma, Advocate for the appellant stated that the delay was caused due to the reasons as stated in the application.

After considering all facts, the delay of 60 days in filing the present appeal stands condoned. The application is allowed accordingly.

Thepresent application is filed for revival/restoration of the appeal which was disposed of vide order dated 08.04.2024 for want of pre-deposit. The Registry reports that the appellant made 25% pre-deposit i.e. Rs.5,85,000/- of the decretal amount of Rs. 23,35,231.92.

Accordingly, the Misc. Application is allowed and the appeal is restored to its original number.

Issue notice to the respondent. Ms. Usha Singh, Advocate accepts the notice on behalf of respondent. In the meantime, the counsel for the appellant is directed to supply the copy of appeal paper book along with annexed documents to the counsel for the respondent within 3 days.
