Judgment
The order dated 09.04.2026 of the Registrar would reflect that the service has been effected upon Respondent Nos. 7, 8(A), 8(B), 8(C), 9(B), and 10. Despite service, there is no representation on their behalf.
Accordingly, the proceedings against these Respondents be proceeded ex parte.
The I.A. No. 199/2023 is filed by the Appellant for condonation of the delay in filing the present Appeal.
The Learned Counsel for the Appellant would submit that there is a delay of 49 days in the filing of the present Appeal and the delay was caused due to some confusion arising out of several litigations.
The Learned Counsel for the Respondents vehemently opposed the delay condonation application.
However, the I.A. No. 199/2023 is allowed and the 49-day delay in filing of the Appeal stands condoned subject to payment of the cost of ₹10,000/- to the Prime Minister Relief Fund within one week.
At this stage, the Learned Counsel for the Appellant prays for a hearing of the I.A. No. 290/2026 with a prayer to delete Respondent No. 9A.
The Learned Counsel for the Respondents have no objection to the same.
Accordingly, the I.A. No. 290/2026 is allowed and the Appellant is directed to file an Amendment Memo of the parties within one week.
List the case on 15.09.2026 for further proceedings.
